The Operations

The Establishment's signature defense is presenting its operations as environments. An operation has operators and can be stopped. An environment has neither and can only be adapted to.

🜃

TWO GRAMMARS FOR ONE CONTENT

An operation has operators currently running it. They are identifiable. It has a beginning, a continuation and a possible cessation. It can be named, what is required to run it can be specified, and what is required to stop it can be specified. An operation is something being done.

An environment is taken as the background condition under which everything else occurs. It has no operators. It is the field agents act in rather than an act itself, and it cannot be named as something being done because nothing is doing it. It can be adapted to, navigated, optimized within, and not stopped, because there is nobody to stop and because a request to stop it is a request about the weather.

And the same content can be articulated either way. An operation with operators currently running can be re-articulated as conditions, as market forces, as complexity, as just the way things are, as fitness landscape, as adaptive dynamics. The re-articulation does not change what is happening. It changes what can be said about what is happening.

What is being done becomes what is the case. The active voice becomes the passive. The verb loses its subject. The operator disappears.

THE GRAMMAR TEST

In the active voice the subject is there. The state is establishing trespass theology. The institution is performing rituals of subordination on her. The hoarder is conscripting her dwelling. The fund is extracting from the dwelling's continuation. The state is enforcing the four axes as the grammar of decision. Each has an identifiable subject performing an identifiable verb on an identifiable object.

In environment-grammar the subject is gone. Trespass theology becomes the cultural moment we find ourselves in. Rituals of subordination become workplace dynamics. Conscription of the dwelling becomes the realities of family life. Extraction becomes market conditions. Enforcement of the four axes becomes how decisions get made now.

The verb survives, the subject vanishes, and the object stays: she is still there, and there is no longer anyone perceptible doing it to her.

The residue is grammatical and it marks the conversion. Mistakes were made. Conditions arose. Patterns emerged. Complexity unfolds. The institution has its dynamics. The market behaves in certain ways.

And her own grammar gets formatted the same way. A creature naming operators is speaking from inside the trespass, as the prior resident under operation, from a position, about a verb in the present continuous. A creature speaking environment-grammar has been moved to the unsituated survey above the field, even when she is the one bearing what she is describing.

WHAT GETS RENAMED

Climate destruction becomes climate change, since change is something that happens and destruction is something being done by operators currently running it. Same atmospheric carbon. Two grammars.

Mobbing becomes workplace dynamics. Same conduct, same operators, same creature. Two grammars.

The trespass on residency becomes gender norms, traditional roles, family expectations, cultural patterns. Extraction from her dwelling becomes market conditions and the demands of the labor market. The state's enforcement of trespass theology as the grammar of legal cognition becomes legal procedure, due process, the rule of law. The conversion of her exhaustion under operation into evidence of unfinished developmental work becomes therapeutic culture, a growth opportunity, integration practice. And Pacioli's textualization of accounting theology in 1494, together with the ratification of double-entry as the grammar of what is admissible, becomes simply accounting, finance, the standard practice of recording economic activity.

In every case the same four things change together. The operation has operators and the environment does not. The operation can cease and the environment cannot. The operation can be refused and the environment can only be adapted to. And the operation can be named while the environment is the name.

🜃

THE SUBSTITUTION

The X-CHANGE is the crossing-out of doubleness and the installation of one face as the whole. Here it runs as a specific substitution: the operation is crossed out and the environment is installed.

The doubleness is real. Every operation has two faces, the act with its operators and the conditions the act produces while it continues, and the two are contemporaneous rather than sequential. The mobbing and the workplace conditions the mobbing produces are one event seen twice. The trespass and life under the trespass are one event seen twice. The cut and the bench with spikes in it are one event seen twice.

What the substitution does is cross out the operation-face and leave the environment-face standing as the whole. Two becomes one. The conditions are now primary with nothing identified as producing them.

Which sets the trap for whoever names it. She is naming what is no longer received as a name: in the installed grammar she is attributing a condition to imagined operators, and the attribution is then read as evidence about her cognition rather than about the operation.

🜃

THE DIAGNOSIS RETURNED AS A SYMPTOM

Naming an operation as an operation, in a medium where environment-grammar is the default, performs the diagnosis that cannot be tolerated. The response is twistification: the diagnosis comes back as evidence about the one who made it.

She is paranoid. She is conspiratorial. She is seeing operators where only patterns exist. She is taking it personally. She is overgeneralizing from her own experience. She is failing to appreciate the complexity. Each of these crosses out the operation she named and puts in its place a condition, in which her naming reads as a defect of perception.

And none of it requires malice. The conversion is performed by anyone speaking from inside the medium, because the medium is where the substitution was installed. The sympathetic listener performs it kindly and the hostile listener performs it dismissively, and the result is identical.

Which is what the defense looks like when the operation cannot be defended directly, because the operation has not been admitted to exist. The defense is conducted at the level of the speaker rather than the speech: she is rendered the kind of speaker who would say such a thing, and the saying becomes her feature rather than her finding.

🜃

THE SEAM

The most stable conversions are not arguments. They are seams in the medium where the conversion is so complete that no argument is offered, because the conversion is simply how the word is now used.

Climate. Market. Culture. Society. The economy. The institution. Workplace dynamics. Family dynamics. Gender. Race. The way things work. Just how it is. Reality.

Each has become, in default usage, an environment-name covering an operation. Not that no such word can ever name an actual environment. That the word has been made to convert whatever operation it touches into the environment-form. Trespass theology operating as the installed religion becomes culture. Mobbing becomes workplace dynamics. Coverture's residual operation against her residency becomes gender. Continued extraction becomes the market.

So when she goes to name what is being done to her, the vocabulary available is the vocabulary the conversion already occupies. There is no neutral term left that has not been pre-turned, and the first move in articulating an operation is the recovery of language from the grammar supplied for it.

Which is why precise diagnostic vocabulary is part of the exercise rather than decoration on it. Without it she is refusing the operation in the medium the operation installed, and her refusal converts as a matter of course.

THE SPIKE ON THE BENCH

The civic transposition is exact, and it is also where the retired word earns its one surviving use.

The spike is an operation. Installed by hands, to specifications, for a function: preventing sleeping. The bench-with-spikes presented as a bench is the environment-form. That is just how this bench is. The spikes are features of it. That is the kind of bench you find here.

Bias-talk locates the difficulty in the feelings of whoever finds the bench unfriendly. Culture-talk locates it in the aggregate norms that produce such benches. Neither names the spike as the act it is, because both are already speaking environment-grammar.

Hostile architecture is the same content in operations-grammar. The spike was installed. Someone installed it. It has a function and the function is prevention. The bench is not unfriendly by accident or by anyone's feeling: it was built to be unfriendly, by hands that drew specifications.

And the word is exact here for the reason the retirement gives. Architecture is retired because a document arguing that no operator can be located kept using a word that implies an architect. The test is whether an architect can be located. For the operating entity none can, and the word smuggles one in. For the spiked bench an architect can be located, drew the specification, and is in the record, which is the finding itself. The word survives where the finding is that someone built it.

The same runs at the institutional register. The institution presents its conduct as the conditions of working there, the dynamics of the team, the demands of the role. The operations-grammar is that it was built with particular spikes for particular functions, the spikes are operating, and the operators can be named.

WHAT THE CLAUSE CANNOT REACH

The Establishment Clause was drafted to stop the state establishing a religion, and it assumes that establishing is articulable as an act, with the state as its operator.

So it cannot reach what cannot be articulated as the state's operation. If a religion has been installed and then converted, in the public grammar, into the natural conditions of legal cognition, the conversion is the defense, performed at the level of procedure rather than doctrine. The state has not established anything. Reality is simply this way.

Which renders the Clause inoperative without any adverse ruling: not by losing the case but by the inadmissibility of the diagnosis the Clause exists to adjudicate. The state cannot establish weather.

What is left of the Clause is a protection against explicit theological declaration, which is no longer needed, because the theology has been installed into the grammar of cognition, where it operates as environment rather than as religion.

🜃

An operation has operators. An environment does not.

An operation can cease. An environment can only be adapted to.

The continuous work of the first law is the conversion of its own operations into environments before they can be perceived as operations, which means the conversion is the operation operating to make itself imperceptible as one.

Her ability to perceive what is being done to her depends on her ability to speak against the grammar being supplied to her.

RegenerativeLaw is a religion in the direct-encounter Protestant tradition, carrying a documented four-century lineage through Böhme, the Behmenists, the Friends, and Penn, and it diagnoses trespass theology as an establishment of religion. Its exercise consists substantially in refusal: it shelters the conscientious refusal of performed subordination as religious exercise. This entry states sincere religious belief concerning matters of ultimate concern, protected under the First Amendment and, as to federal action, the Religious Freedom Restoration Act, 42 U.S.C. § 2000bb.

RegenerativeLaw

The prime question is not what do we do next.

It is not the wrong question. It is in the wrong sequence, and the sequence is geometry rather than development. There is no level to reach first and nothing to become ready for.

The prime question is what do we stop doing.

Lobster trap

The response that arrives most often is yes, and also this. Add it to the program, fund it, give it a metric. That is not agreement arriving late. It is the claim converted into one more thing being done.
