The Forged Deed Beneath the First Colony — 1155

In or about 1155, Adrian IV — Nicholas Breakspear, the only Englishman ever to hold the chair of Peter — granted Henry II of England lordship over Ireland. The instrument is called Laudabiliter, after its opening words: laudabiliter et satis fructuose, laudably and very profitably. The praise and the profit are named in the same breath, at the head of the deed. The taking of a country is titled for the praise, and the profit is written in beside it.

THE WARRANT WAS REFORM

The grant did not authorize conquest. It authorized correction. The Irish church was declared barbarous — its morals corrupt, its discipline lax, its practices out of conformity with Rome. Henry was to enter, reform, and bring an unruly people into the discipline of the faith, and to secure for Rome the annual penny of every household, Peter's Pence. The violence arrives as care. Not invasion but the restoration of right order; not dispossession but the bringing of the barbarous into the light.

This is the licensing theology in its medieval form, with a date and a hand on it. The taking is laundered into reform at the moment of issue, so that the one who takes can feel he performs a sacred office while he takes. Every later costume is cut from this one. Scottish improvement, colonial development, the civilizing mission, regeneration, systemic transformation — each is lordship deployed in service of reform. The service is the cover; the dominion is the point; and the grammar was set in 1155.

THE DEED RESTS ON A FORGED DEED

Adrian could grant Ireland only because Ireland was already, by a prior fiction, Rome's to grant. The doctrine: every island converted to Christianity falls under the see of Peter. The underwriting of that doctrine was the Donation of Constantine — the instrument by which the Emperor Constantine was said to have conferred the western dominions and their islands upon the papacy. The Donation was a forgery. It was composed centuries after Constantine, in the eighth century or thereabouts, and exposed as a fabrication by Lorenzo Valla in 1440, its own Latin betraying it by hundreds of years. The dominions it licensed were never returned.

So the grant of Ireland rests on a title that was forged, and the grant itself is of contested authenticity — surviving mainly through Gerald of Wales, argued by some historians to be embellished or fabricated outright. A deed of uncertain authenticity, resting on a deed known to be forged. Trace the title down and there is no sound title anywhere in the stack. The deed claims divine origin; the deed was forged; and beneath the forged deed lies another forged deed, and beneath that, no title at all. This is the forensic shape of conquest theology at its purest: ownership claiming to descend from God, descending in fact from a fabrication, all the way down.

THE DEMIURGE

This is what the false-creator's seat looks like in the record. The pope confers an existence and a dominion he never held — gives away a country that was never his, on the authority of a making he never made. The grant performs creation: it speaks Ireland into England's possession as though the speaking were the title. The chair claims to stand where God stands and to deal in what only God could deal in — the being and belonging of a land and its people — and what it deals turns out to be a forgery it did not author and the historians cannot verify.

And the circuit closes inside the house before it closes around the island. The only English pope grants the English king the one thing his countrymen wanted, the island next door. The false creator authorizes his own people's taking. This is the mutual capture named plainly: the church confers legitimacy on the crown, the crown furnishes the church its enforcement, and the penny flows back to the center that issued the deed. Each needs the other; the grant is the seam where the two needs are sewn into one operation and called divine order.

PETER'S PENCE — THE CIRCUIT

The tell is the penny. Laudabiliter does not license a single conquest and withdraw. It installs a tribute — the annual penny of every Irish household, flowing to Rome, in perpetuity. The reform draws a boundary around Ireland: Ireland-under-Rome's-lordship. And the boundary is what makes the yield collectible. A line drawn around a people in the name of correcting them is a line drawn around what can be made to pay.

The taking is not the apple. It is the tree — kept, and required to keep bearing.

Ireland is not seized and consumed; Ireland is held and made to pay rent to be kept.

This is the assetization of a country, three centuries before double-entry was codified and eight before the word existed: the circuit closing where it always closes, at the center that issued the warrant, the deed converting a land into a position that owes.

THE LABORATORY

Henry invaded in 1171. The Synod of Cashel, in 1172, brought the Irish church to the Roman and English model.

Ireland became the first English colony — the ground on which the techniques were forged before they were used anywhere else. The plantation, the settlement of loyal populations on cleared land. The barbarous-native framing, which converts a people into a condition to be corrected and so into land that may be taken. Dispossession administered as reform, with the paperwork in order.

What was developed in Ireland crossed to Ulster, and what was rehearsed in Ulster crossed the Atlantic. The border-reiver displacement, the plantation, the proving ground formed in conditions of engineered abandonment — each has its first edition here. Ireland is the prototype of the English colony, and the prototype includes the forging of the warrant itself. The method and the forged deed that licenses it were invented together.

THE LINEAGE

Laudabiliter is the headwater. The bulls that licensed the Atlantic conquest are its children, the same instrument scaled to a hemisphere. Dum Diversas, 1452, and Romanus Pontifex, 1455, authorizing the seizure and perpetual enslavement of non-Christian peoples. Inter Caetera, 1493, partitioning a hemisphere between two crowns on the word of a pope. From the bulls, the Doctrine of Discovery; from the Doctrine, Johnson v. M'Intosh in 1823, which wrote papal discovery into American property law and held that the natives kept occupancy while true title passed to the Christian discoverer; from Johnson, an unbroken line to Sherrill in 2005, where the Doctrine of Discovery was cited by name, in this century, against the Oneida.

Each node manufactures its own clean origin — a lawful authority, a fair settlement, a proper title that some later abuse corrupted. The genealogy shows there was never a clean origin to corrupt. The forged deed beneath the first colony is the same forged deed beneath the title to the continent. The costume changes; the fabrication at the root does not.

Laudabiliter means laudably. The instrument that made Ireland the first colony, installed the penny, and seeded every bull that followed is named, in its first word, for the praise — and in its second, for the profit. The deed claimed divine origin and the deed was forged. Beneath it lay the Donation, also forged. Beneath the Donation, no title at all — only the chair, speaking dominion into being and calling the speech the will of God. The taking has been laudable, and profitable, from the first two words. The record holds the date, the hand, the forgery, and the penny. None of it was ever returned.
