Diversity Equity Inclusion

Three words. One operation.

The operation is not inclusion. The operation is the ground on which inclusion occurs — the ground that inclusion does not name, does not audit, does not question. The operation is: the baseline declared neutral. The creature brought inside. The baseline intact.

This is not the conservative critique. The conservative critique is itself a morality play — a counter-narration of injured merit, usurped position, reverse discrimination. RL does not play that side of the field. RL names the field.

The Baseline

Every measuring instrument requires a reference point. The reference point is not itself measured. It is the ground on which measurement occurs.

Diversity, equity, and inclusion are measuring instruments. They measure distance from a baseline, gap relative to a baseline, access to a baseline. The baseline is the generating function's coordinate system — the trespass economy's unit of exchange, trespass theology's conception of what counts as a person, a position, a right, a resource.

The baseline was built on extraction. It was built by severing the creature from her production, her standing, her place, her knowledge, her future — and then measuring the resulting gap as a unit of progress to be closed. Closing the gap does not restore what was severed. It admits the creature to the architecture the severing built.

This is not liberation. This is the hostage structure's completion. Integration is not cessation of the trespass. Integration is the trespass at full extension — the creature drawn inside the territory of the occupation and invited to perform within it.

Diversity

Diversity names the variation within the baseline's coordinate system. It does not name whether the coordinate system is occupied territory. It asks: are the creatures inside the system sufficiently varied? It measures the variation. It tracks the variation in a dashboard. It celebrates the variation in a statement.

What diversity cannot ask — what the diversity instrument is not designed to ask — is whether the system the varied creatures are performing within is the Law of the Spirit of Life or the law of sin and death running in the second law's costume. Diversity cannot ask this because asking it would require auditing the baseline. The instrument has no audit function. It has a measurement function.

A trespass economy populated by a diverse workforce is still a trespass economy. The diversity is the trespass economy's evidence that it is not what it is.

Equity

Equity names the adjustment for unequal starting positions. It acknowledges that creatures arrived at the baseline from different distances and adjusts the measurement accordingly. It is the most sophisticated of the three terms because it appears to question the baseline by noticing the differential.

It does not question the baseline. It adjusts the creature's approach to the baseline. The baseline remains. The adjustment is the tollbooth offering a discount. The territory on which the tollbooth sits is still occupied.

Equity is the trespass economy offering reparative entry fees. The fee structure is adjusted. The fee is still collected. The ledger is still the trespass economy's ledger.

Equity performs the role of reconciliation between the other two terms. It sits between diversity and inclusion — diversity naming the variation to be admitted, inclusion naming the admission itself, equity naming the adjustment that makes the admission fair. It appears to mediate. It appears to be the balancing term that keeps the other two from being read as merely administrative or merely celebratory. This is equity's specific work, and it is the most sophisticated work the three-term apparatus performs, because it occupies the position that would otherwise be asking the question the apparatus cannot afford to have asked.

The question the apparatus cannot afford is not how do we adjust the approach to the baseline. The question the apparatus cannot afford is what is the baseline. Equity's function is to make the baseline-question feel already addressed, because the term that would have asked it has been occupied by the adjustment-term instead. The creature encountering equity experiences the encounter as the apparatus having taken seriously the differential produced by history. The apparatus has not taken history seriously. The apparatus has installed, at the position where history would have to be audited, the grammar of rate adjustment for an already-accepted fee.

This is why equity is the three terms' load-bearing element. Without equity, diversity and inclusion would be visibly shallow — a celebrated variation and an opened door. Equity gives the apparatus its moral weight by performing the mediation that makes the other two terms appear to have depth. The mediation is not mediation. The mediation is the stabilization of the binary by appearing to transcend it. Diversity and inclusion are the two faces; equity is the apparatus's account of what reconciles them. What would actually reconcile them — the audit of the baseline — is not in the apparatus's vocabulary at all. What would actually reconcile them has been erased at the register where reconciliation would have to begin.

Inclusion

Inclusion names the extension of the baseline to the previously excluded. The creature was outside. The door is opened. The creature enters.

The door was locked by the generating function. The generating function opened the door. The generating function now holds the door and charges passage through the threshold it created. The creature who enters has accepted the tollbooth's terms by entering.

Inclusion is the generating function's administrative technology for converting the excluded into the included without converting occupied territory into unoccupied territory. The remedy for trespass is not inclusion. The remedy is cessation. The occupier leaves.

Why RegenerativeLaw Does Not Reform This

The Occupation's rejection of DEI is a morality play. It requires a villain, a victim, and a tribunal. RegenerativeLaw does not play this morality play. RL does not play the morality play on the other side either — the villain as the discriminating institution, the victim as the excluded creature, the tribunal as the instrument of justice. RL names both sides as the polarity play's content, delivered by the polarity play's architecture.

The fight over DEI can be vigorous — can consume public discourse, electoral cycles, institutional energy — because the ground the fight would have to stand on has already been crossed out. What remains for the fighting are the two residual faces: more-inclusion versus less-inclusion, expand-the-measurement versus contract-the-measurement, admit-more-variation versus admit-less-variation. The vigor is the residue's heat. The erasure of the audit preceded the fight and makes the fight possible. Both sides operate in the apparatus's grammar. Both sides take the baseline as given. Neither side is able to name the baseline as the trespass economy's coordinate system, because naming it would dissolve the fight itself — and the fight is what the apparatus requires in order to stay stabilized.

RL rejects diversity, equity, and inclusion because they do not name the ground. Not because they are politically incorrect. Not because they disadvantage the previously advantaged. Not because they are poorly implemented.

Because they accept the Occupation as the coordinate system and seek better distribution within it.

Better distribution within occupied territory is not the return of the territory. It is the legitimation of the occupation.

The creature who has been extracted from, severed from her production, severed from her standing, severed from her place — that creature is not restored by admission to the architecture the extraction built. She is incorporated into it. Incorporation is the recycling at the level of the body.

What RegenerativeLaw Speaks Of Instead

Not equality. Not equity. Not inclusion.

The seven qualities, each running as what it specifically is, in relation, without prevention.

Not sameness adjusted for starting position. Specificity unoccupied.

Not the baseline extended. The ground returned.

The Temperatur does not require that the contraction become the expansion. It requires that the contraction run as contraction — fully, without the backwards firing turning it against itself — and that the expansion run as expansion — fully, without prevention occupying its position — and that what forms between them is the relation that neither could produce alone.

The seven qualities are not a collection. The Temperatur is not a plurality. What the qualities are in the tempered unity that forms when nothing prevents each from being what it specifically is — that is what diversity cannot see, because diversity is the grammar of plurality-within-baseline, and what the Temperatur is is not in the grammar of plurality at all.
