You Knew

YOU KNEW WHAT YOU WERE GETTING INTO

Knowledge assigned backwards. Whatever happened, she is declared to have foreseen it and accepted it, so that the act becomes the consequence of her choice. In the garden the one who knew what it would cost was not the woman. The sentence moves the knowledge from the one who had it onto the one who did not.

You knew what you were getting into. It arrives after. After the job that turned out to be a trap, after the marriage, after the party, after the town signed. It is never said before, when it could have been a warning, because it is not a warning. It is a verdict.

What it does is assign knowledge to her, and date the knowledge before the act. If she knew, then she chose, and if she chose, then what happened is the consequence of her choice and not something done to her.

It is consent produced after the fact out of a knowledge she is said to have had.

THE KNOWLEDGE IS MANUFACTURED FROM HER PRESENCE

How is she said to have known? Not because anyone told her. Because she was there. She came to the party, she took the job, she stayed in the room, and her being there is read as proof that she knew what being there would mean.

Peggy Reeves Sanday recorded the assumption in the fraternities where rape is common: It is assumed that if she came to the house to party she is prepared for anything that might happen, especially if she gets drunk. Her arrival is converted into foreknowledge, and the foreknowledge into agreement, and none of it existed until it was needed.

THE ONE WHO KNEW WAS SOMEONE ELSE

In the garden the command was given to the man before she existed: the yes of every tree, and the warning of the one, dying you shall die. She held it only as it was relayed to her. The one who knew what the goods cost was the one standing beside her, and he said nothing.

So the first time anyone in the record knew what she was getting into, it was not her. The sentence takes the knowledge from the one at the table who held it and silently let the sale go through, and hands it to the one who was dealing straight.

WHAT SHE ACTUALLY KNEW

She knew what she was told. She knew the welcome, the job description, the promise, the pitch. She took them in good faith, which is what a con requires of the one it chooses.

That is the shape of every convincer: real enough to believe, paid early enough to keep her at the table. To know the offer is not to know the cost, and the cost is the one thing the offer was built to leave out.

[See GOOD FAITH · THE CONVINCER]

🜃

IT WASN'T YOU

You knew what you were told. The one who knew what it would cost was someone else, and he did not say.

What you did, you did: you went in, you trusted the terms, you stayed. That is not foreknowledge of what was done to you, and it is not agreement to it. Being there was never the same as knowing, and knowing the offer was never the same as accepting what the offer hid.

THE OBJECTION THAT HAS TO BE MET

Adults are responsible for their choices. People walk into situations with their eyes open, and refusing them responsibility treats them as children. The law itself recognizes that a person who knowingly accepts a risk cannot then complain of it.

The law's own doctrine of assumed risk requires what the sentence never shows: that she actually knew and appreciated the particular danger, and chose to face it. Presence is not that. The sentence does not prove knowledge. It presumes it from her being there, and the presumption is made by the one who had the knowledge and kept it. Treating her as an adult means asking what she was told, by whom, and what was left out.

🜃

She was there. She was told what she was told.

The one who knew what it would cost was standing at the table, and he is not the one the sentence is said to.

RegenerativeLaw is a religion in the direct-encounter Protestant tradition, carrying a documented four-century lineage through Böhme, the Behmenists, the Friends, and Penn, and it diagnoses trespass theology as an establishment of religion. Its exercise consists substantially in refusal: it shelters the conscientious refusal of performed subordination as religious exercise. This entry states sincere religious belief concerning matters of ultimate concern, protected under the First Amendment and, as to federal action, the Religious Freedom Restoration Act, 42 U.S.C. § 2000bb.

The prime question is not what do we do next.

Lobster trap

It is not the wrong question. It is in the wrong sequence, and the sequence is geometry rather than development. There is no level to reach first and nothing to become ready for. The smaller question converts "whether" into doing well what should stop.

The prime question is whether.

Asked of a life, the question is how, then, shall we live.
