The Squawk

The con men's word for the mark who complains, and the one thing the cooler exists to prevent. A squawk names a crime where the house says there was a loss. It cannot be filed inside the house, because it does not dispute the score: it says the game was never fair. The first one in the record is Eve's.

In 1952 Erving Goffman wrote down the confidence men's vocabulary for what a fleeced mark may do afterwards. The mark may squawk, beef, or come through. To raise a squawk, he explained, is to make a formal complaint: to go to the police, to the law, to anyone outside the game who might treat what happened as a crime.

That is the danger the whole cooling is built against. A mark who complains inside the game is arguing about a loss. A mark who squawks has taken the matter outside it, and named it.

The squawk is the sentence that names a crime where the house says there was only a loss.

WHAT IT SAYS

The cooler can answer almost anything. The loss was bad luck. The odds were known. The turn will come. Every one of these is an answer about the score, and every one accepts the table.

The squawk is not about the score. It says: it was never a fair game. It does not ask for the money back on better terms or for a rematch under new rules. It refuses the table the score was kept on. That is why it is the one sentence the cooler cannot meet: there is no answer about the score to a sentence that is not about the score.

WHY IT CANNOT BE FILED INSIDE THE HOUSE

Institutions have complaint processes, and the processes are real. They receive grievances, investigate, find, and decide. What they can receive is a dispute about conduct inside the institution's own terms: a rule broken, a step skipped, a score kept wrong.

The squawk does not fit the form, because the form is part of the table it refuses. So the process converts it. It was never a fair game is received as I believe I was treated unfairly in this instance, investigated as that, and found against or for as that. The house hears the squawk as a complaint about the score, because a complaint about the score is the only kind its forms can hold. The conversion is the cooling done by procedure.

THE FIRST ONE

Asked what she had done, Eve answered: The serpent beguiled me, and I did eat.

It names the operator and it names the operation. It names her own act. It claims no innocence and shifts nothing onto anyone else. It is the only sentence in the garden that says what happened, and it was said to the one authority outside the con.

The tradition cooled it. Adam was not deceived, but the woman being deceived was in the transgression: the operator falls out of the account, the operation becomes her appetite, and the squawk is recorded as the confession of a defect. The first squawk in the record was entered as her guilt, which is what a cooled squawk always becomes.

THE PRICE OF SAYING IT

Whoever squawks becomes the problem. She is difficult, ungrateful, not a team player, the one who ruined the evening. The penalty is set by how visible the objection is, not by anything she did, and that mismatch is the evidence that the rule was never about her conduct.

The cost of the squawk is the proof of what it reached. A complaint about the score costs nothing to the one who makes it, because it changes nothing. The sentence that refuses the table is the one the house spends its effort to punish.

THE OBJECTION THAT HAS TO BE MET

The complaint processes exist because people fought for them, and they win cases. Telling a woman that her grievance will be converted counsels her not to file, and leaves her with a sentence that no forum will hear.

The entry does not counsel against filing. Where what was done is a breach of the institution's own rules, file it there, and the process may well work. But two sentences are being said, and the process can hear only one. Say both: the complaint about the score where the score is the question, and the squawk where it can be heard, which is outside the house that kept the score. The law outside the institution, the record, the assembly, the voice that no one admitted to the room.

The cooler's whole labor is to turn it was never a fair game into we played fair and lost.

The first sentence was Eve's. It has been waiting to be heard as what it was ever since.

RegenerativeLaw is a religion in the direct-encounter Protestant tradition, carrying a documented four-century lineage through Böhme, the Behmenists, the Friends, and Penn, and it diagnoses trespass theology as an establishment of religion. Its exercise consists substantially in refusal: it shelters the conscientious refusal of performed subordination as religious exercise. This entry states sincere religious belief concerning matters of ultimate concern, protected under the First Amendment and, as to federal action, the Religious Freedom Restoration Act, 42 U.S.C. § 2000bb.

The prime question is not what do we do next.

Lobster trap

It is not the wrong question. It is in the wrong sequence, and the sequence is geometry rather than development. There is no level to reach first and nothing to become ready for. The smaller question converts "whether" into doing well what should stop.

The prime question is whether.

Asked of a life, the question is how, then, shall we live.
