Five Relations

A witness about modes of ordering. The relations are ranked and the duties run both ways and are written down, which makes the order refusable in a way that an order denying it ordered anything is not.

The five human relations are stated in the Mencius, at Book III Part I, where Shun appoints a Minister of Instruction. Legge's translation: he appointed Xie to be the Minister of Instruction, to teach the relations of humanity: how, between father and son, there should be affection; between sovereign and minister, righteousness; between husband and wife, attention to their separate functions; between old and young, a proper order; and between friends, fidelity.

Read what the sentence assumes before it prescribes anything. The unit it describes is not a person who has relations. It is a person who is constituted in them, so that the duty is not an obligation a bounded individual takes on afterwards but the form in which that individual exists at all.

THE TEN, AND THE PAIR THEY LEAVE OUT

The reciprocal duties are enumerated in a different text, and the difference matters more than the enumeration.

The Lî Kî, at the nineteenth paragraph of the Lî Yun, in Legge's translation: What are 'the things which men consider right?' Kindness on the part of the father, and filial duty on that of the son; gentleness on the part of the elder brother, and obedience on that of the younger; righteousness on the part of the husband, and submission on that of the wife; kindness on the part of elders, and deference on that of juniors; with benevolence on the part of the ruler, and loyalty on that of the minister; these ten are the things which men consider to be right.

Count the pairs and they are not the five. The Lî Yun has father and son, elder brother and younger brother, husband and wife, elders and juniors, ruler and minister. The friend is not in it. Ten obligations across five pairs, and every pair has a superior and an inferior.

So the two texts do not simply repeat each other, and the ten cannot be read as the duties of the five. The text that enumerates what is owed in both directions enumerates it only where there is an above and a below, and the one relation in the canonical five with no above and no below has no entry in the list. That is the enumeration telling the reader what it is built to measure.

WHERE IT CONVERGES

Two things in this ordering are the direct refusal of what trespass theology installs.

The person is constituted in relation rather than as a bounded unit that afterwards enters agreements. That is the proposition self-ownership makes unavailable: a creature who owns herself is complete before she meets anybody, and everything after that is transaction.

And the obligation runs in both directions. The ledger does not do this, and the asymmetry is the whole of it: the books stay open against the creature and closed in the holder's favor. A father owes kindness, a ruler owes benevolence, and the owing is recorded in the same sentence that records what is owed upward.

AND IT IS ORDERED-UNDER, WHICH IS NOT SUBTLE

Four of the five assign position by birth, by sex and by age.

None of those is chosen and none can be altered, so the assignment is sub-ordinatus on the single line the cut installed, with a cosmology attached to hold it. And the husband and wife duty is the one to read closely: separate functions, stated as doctrine in the canonical text rather than smuggled in later as nature. The public and private division is not a modern settlement concealed behind an ideology here. It is written on the face of the instrument.

THE CONTRAST THAT CUTS IS NOT HIERARCHY AGAINST EQUALITY

It is stated and reciprocal against denied and one-directional, and taking it as the first pair loses the finding.

This order assigns openly, names the positions, and writes down what is owed downward. So the party in the lower position can say you owe me benevolence and point at a text. Failure by the superior is nameable, and at the top of the order it is more than nameable, because the mandate can be lost.

Trespass theology holds the same graduation and denies that it assigned anyone anything. There are no positions, only merit, contract and market outcome. Nothing is owed downward because no relation is admitted to exist, so the creature has no claim to make, and not because her claim fails: there is no relation in which to lodge it.

SO THE COVERT ORDER IS HARDER TO REFUSE THAN THE OVERT ONE

An order that states its obligations can be held to them.

An order that denies having any can only be complained about, and a complaint is a grievance rather than a claim. The first supplies the instrument of its own contestation in the act of stating itself. The second withholds the instrument by withholding the admission that there is anything to contest.

AND IT PUTS PRESSURE ON THE FOUNDING'S STORY ABOUT ITSELF

The move from status to contract is narrated as liberation. No more fixed stations, everyone free to bargain.

Read against the five relations, what happened is narrower than that. The subordination was kept and the reciprocal duty was deleted, and the deletion is what got called freedom. At-will employment is the cleanest specimen there is: the graduation is complete, the obligation downward is nil, and the whole of it is described as mutual.

The folder already holds one end of that thread. The Master and Servant Acts are in it, and what they show is a regime that at least named the master as a party with duties before the naming was dropped.

THE LIST CONTAINS ITS OWN EXCEPTION

Friend to friend has no superior and no inferior, and its virtue is fidelity. It sits in the canonical five as an equal term and is not presented as the lesser member.

That relation is the shape this work builds on, and the convergence is exact: alongside rather than above, with-ness rather than administration. So the tradition that most explicitly ranks relations records, in the same breath, one relation that is not ranked and is not thereby diminished.

And the Lî Yun is the confirmation from the other direction, because it is the text that leaves the friend out. The unranked relation survives in the list of five and cannot be entered in the list of ten, since there is no direction for its duty to run in.

All of this enters as a witness about modes of ordering and nothing more. It is not an argument that a Confucian order is preferable, and it is not offered as a model to return to: four of its five relations assign position by facts the creature did not choose.

What it establishes is comparative. An order can rank and still owe, and can write the owing down where the ranked party can read it. Whether the American configuration is an establishment of religion is a separate question, argued on the record and the cases, and nothing here touches it.

It is not the wrong question. It is in the wrong sequence, and the sequence is geometry rather than development. There is no level to reach first and nothing to become ready for. The smaller question converts "whether" into doing well what should stop.

The prime question is whether.

Asked of a life, the question is how, then, shall we live.
