The good will of a party who could do otherwise. Not a disposition but a position's conduct, and the position is what the word is selecting for.
🜃
Benevolence is well-wishing that can be acted on downward, and the word is unavailable in any other direction.
Test it against the vocabulary rather than against the sentiment. A sovereign is benevolent towards subjects, a master towards servants, a guardian towards a ward, a benefactor towards a beneficiary, an employer towards the staff kept on through a bad quarter, a god towards creation. Reverse any of those pairs and the sentence stops working. A subject may be loyal, dutiful, devoted, faithful or grateful, and she is not benevolent towards the sovereign, and that failure is not an accident of idiom. Benevolence is not something a creature has, it is something a position permits, so a word that runs in only one direction has reported the shape of the relation before it has said anything at all about the conduct.

WHAT THE RELATION PRESUPPOSES
Four conditions have to hold before a benevolent act is intelligible as one, and none of them is stated when such an act is described.
A disparity. One party can act on the other and is not equally exposed to being acted on in return. Where that is absent there is help, or a favor, or what was already owed, and none of those requires the word.
That the disparity is not the subject. Benevolence operates on the condition and not on what produces the condition. An act that closed the distance would end the relation, so the relation selects continuously against that act and in favor of acts that relieve without closing.
Discretion. The act was chosen, could have been withheld, and can be withheld tomorrow without a reason being supplied. That is what makes it creditable to the one who performs it, and it is the same property that makes it unavailable to plan around: praiseworthy and unreliable are one feature described twice.
Gratitude as the answer. Not repayment, which would require the lower party to hold something the upper party needs. The account closes in affect because it cannot close in kind.
The four are the relation, and the act is a reading of them. An act of benevolence confirms the disparity in the same motion in which it relieves it, and the relief is therefore the thing least likely to be refused by the party whose position it confirms.

IT IS NOT OWED, AND THAT IS THE OPERATING CONDITION
An order that ranks openly settles this from the other direction.
The Confucian relations are graduated and the graduation is written down, and so is what runs downward: kindness on the part of the father, righteousness on the part of the husband, benevolence on the part of the ruler. The word is in the text. The consequence of its being in the text is that the party below can say you owe me benevolence and point at a line, which makes a failure nameable as a failure, and at the top of the order more than nameable, because a mandate can be lost.
Trespass theology keeps the graduation and deletes the entry. Nothing is recorded as owed downward, because no relation is conceded to exist that could owe anything: positions in fact, merit in theory, outcomes in the market. What survives the deletion is the conduct without the duty, and conduct without a duty is a gift, so the act that was an obligation in an order that ranked openly becomes a generosity in an order that denies it ranks anyone, and the party receiving it has lost the only thing that ever made it claimable.

THE RETURN LEG IS GRATITUDE, AND IT IS PRICED
The weak offer service in exchange for protection, the protection arrives as a stipend, the stipend is repaid in gratitude, and the strong grow stronger. The last step is the one that looks like nothing.
Gratitude in this position is not a feeling. It is a performance with a standard: audible, prompt, addressed to the correct party, and repeated at intervals the correct party sets. Its absence is chargeable. A relation in which one party's affect is a term of the deal has one party in it, and nothing in that turns on the benefactor's sincerity, because the term is set by the position and is in force whether or not he ever states it.

FRIENDSHIP PRESUPPOSES THE OPPOSITE, ITEM BY ITEM
Friend to friend sits in the canonical five with no superior and no inferior, and the virtue assigned to it is fidelity. Set it against the four conditions and the contrast is exact at every one.
Standing. Friendship presupposes parties who can each act on the other. Aristotle makes the disparity the limit rather than a difficulty: at a great enough distance, as towards a god, friendship is no longer possible, and where the parties are unequal it holds only if the superior is loved more than he loves, which is to say it holds by becoming unequal in a second currency.
Disclosure. Henceforth I call you not servants; for the servant knoweth not what his lord doeth: but I have called you friends; for all things that I have heard of my Father I have made known unto you. The verse locates the difference in what is known. A benefactor need not say why, and his reasons remain his without any failure on his part. Benevolence is fully compatible with the beneficiary never learning why, and friendship is not, which is why one act can be care or administration according to nothing but what was disclosed about it.
Exit. Either friend can end it, at a cost comparable to each. Benevolence is ended by one party at no cost and declined by the other at considerable cost, and a relation with one exit is not the same object as a relation with two.
Direction. Friendship has no beneficiary. The moment one party is the beneficiary the relation has a direction, and a direction is a rank whatever the parties call it.

THE TEST IS WHAT HAPPENS WHEN IT IS REFUSED
A friend can be told no and is still a friend, and the refusal is information about the question rather than about the one who declined.
Benevolence refused does not return to neutral. It converts, and the converted thing has a name: ingratitude. Everything that follows is then read through it. The withdrawal is attributed to the refusal, the disparity is unchanged and unexamined, and the creature who declined is on record as the party who would not be helped. So the refusal does not land on the benefactor, it lands on the account of the one refusing, and a relation whose only exit produces a finding against the party taking it has been built to be unrefusable while remaining, at every moment, a gift.

WHAT IT IS HOLDING UP AT PRESENT
The word has gone out of fashion and the position has not, so the operation runs under other names.
The grant officer who may renew and need not. The facility whose layers de-risk one another while the ground they rest on is not a layer. The prosecutor's charging discretion, exercised over a party graded on her own conduct before the force arrived. Employment at the will of the employer, described to the employee as mutual. The guardian and the ward, where competence is determined by the party whose authority depends on the answer. In every one of them the lower party's only lever is to be legible and to be grateful, and both are performances assessed by the party they are performed for.

THE OBJECTION THAT HAS TO BE MET
The objection is that kindness from a party holding power is better than cruelty from the same party, and that an account which cannot say so plainly is not worth reading.
It is right, and it is not the comparison at issue. The comparison it offers is benevolence against harm. The comparison in front of the creature is benevolence against a duty she could plead. Every improvement available from inside benevolence is an improvement in the benefactor: better terms, a charter of principles, a commitment to listen, a promise to do no harm, all of it granted by the party who may withdraw it and none of it pleadable by the party who relies on it. An enumerated duty running downward is not a better benevolence, it is the end of benevolence as a category, and the parties positioned to write one down are the parties whose standing depends on there being nothing written.

🜃
The question to ask of any relation offered as care is not whether the one offering it means it. Sincerity is abundant, and it is compatible with every condition set out above.
The question is what happens if the creature says no, and whose account the refusal enters.

RegenerativeLaw is a religion in the direct-encounter Protestant tradition, carrying a documented four-century lineage through Böhme, the Behmenists, the Friends, and Penn, and it diagnoses trespass theology as an establishment of religion. Its exercise consists substantially in refusal: it shelters the conscientious refusal of performed subordination as religious exercise. This entry states sincere religious belief concerning matters of ultimate concern, protected under the First Amendment and, as to federal action, the Religious Freedom Restoration Act, 42 U.S.C. § 2000bb.
