The Breakdown

The stage of the con that settles how much she can be taken for. The men who ran the big con did it by hand, for one chosen mark. Surveillance pricing does it for everyone, continuously, from what is known about each of us, and sets the price at the point where walking away is hardest. It is the con personalized, and it is the business plan.

In the big con, the convincer is followed by the breakdown. David Maurer recorded the sequence in The Big Con in 1940: once the mark has been allowed to win, the breakdown settles how much he will put in. It required knowing him: his bank, his property, what he could raise, how badly he wanted the game to be true.

The breakdown was the most expensive stage, because it was done by people, one mark at a time, and a mistake in it could lose the score. What made it costly was that it required knowledge of the one being taken. That cost has now been removed.

THE BREAKDOWN RUN ON EVERYONE

In July 2024 the Federal Trade Commission ordered eight firms that sell pricing tools to explain how they use personal data to set what consumers are charged. Its staff released preliminary findings in January 2025. The firms' tools drew on location, demographics, browsing and purchase history, and inferences drawn from them. One tool could tell where a consumer was at a given moment and tailor the online price to it. Some searches showed higher-priced products first, based on what the shopper had looked at and bought before.

The FTC called it surveillance pricing. In the con's own vocabulary, it is the breakdown, done by machine, for every customer, every time. No one has to choose her. She is already known.

THE PRICE IS SET WHERE SHE CANNOT WALK AWAY

What the breakdown is looking for is not what she can pay. It is the point past which she will not refuse. Surge pricing states it in the plainest form: the price is highest when it is raining, late, urgent, when the alternative is gone. Location tells the tool where she is stranded. History tells it what she always buys.

THE PLANTATION'S BUSINESS PLAN states the rule under every such operation: the enterprise is profitable exactly to the degree that the one it takes from cannot afford to walk away. The trading houses did it with debt. The pricing tool does it with knowledge: it measures how far she is from being able to say no, and charges that distance.

THE CONVINCER IS PERSONALIZED TOO

The same knowledge that sets the high price sets the early gift. The targeted discount, the first order free, the loyalty reward, the price that was low the first time: each is the convincer, real money, paid early, fitted to the one most likely to come back.

So the sequence of the big con now runs inside a single app. She is invited, she wins, she is broken down, and she pays, and every stage was fitted to her. The con no longer needs a confederate who knows her. The knowledge is the confederate.

WHERE THE BREAKDOWN IS COMPUTED

The breakdown runs on servers, and servers stand in buildings that draw water and power from a town. The data center offered to the town as its good fortune is one of the places where the knowledge is held and the calculation is run.

So the building harvests twice, and the two harvests are one operation. It takes the town's water and power to run, and it takes the attention and the record of everyone in the town to compute what each of them can be made to pay. The town is asked to host the machine that will price its own residents.

THE REMEDY IS A DISCLOSURE

New York passed the first law aimed at it, the Algorithmic Pricing Disclosure Act, which requires a seller to tell the customer when a price was set by an algorithm using her personal data. The National Retail Federation sued to stop it, and in 2025 a federal judge dismissed the challenge.

The law is real and it was worth fighting for. And it does what the consent template does. It tells her the breakdown happened, and then the transaction proceeds. The notice is the yes worked out of her: she was told, and she bought. A disclosure answers which word was said. It never asks whether her own life should be used to set the price she is charged.

IT WASN'T YOU

You did not overpay because you were careless. You paid what you were calculated to pay, by a tool built to find the point past which you would not refuse, from what it already knew about you.

What you did, you did: you needed the ride, the room, the groceries, and you bought them. The price was never a measure of what the thing was worth. It was a measure of you, taken without asking, and used against you.

THE OBJECTION THAT HAS TO BE MET

Prices have always varied. Student discounts, senior fares, sliding scales and sales are all price discrimination, and some of them are the only way a person with less can buy at all. A reading that condemns every varied price condemns the sliding scale with it.

The reading does not reach a price that varies so that someone with less can pay less. It reaches the price that varies so that someone who cannot walk away pays more. The test is whose knowledge sets the price, and which way it moves when she is least able to refuse. A sliding scale lowers the price for the one who has least. The breakdown raises it for the one with nowhere else to go.

The men who ran the big con had to study the one they chose.

Now the study is done before she arrives, on everyone, and the price is waiting for her.

RegenerativeLaw is a religion in the direct-encounter Protestant tradition, carrying a documented four-century lineage through Böhme, the Behmenists, the Friends, and Penn, and it diagnoses trespass theology as an establishment of religion. Its exercise consists substantially in refusal: it shelters the conscientious refusal of performed subordination as religious exercise. This entry states sincere religious belief concerning matters of ultimate concern, protected under the First Amendment and, as to federal action, the Religious Freedom Restoration Act, 42 U.S.C. § 2000bb.

The prime question is not what do we do next.

Lobster trap

It is not the wrong question. It is in the wrong sequence, and the sequence is geometry rather than development. There is no level to reach first and nothing to become ready for. The smaller question converts "whether" into doing well what should stop.

The prime question is whether.

Asked of a life, the question is how, then, shall we live.
